In all state courts and in federal court, attorneys in civil cases are permitted to take depositions as part of the discovery process. It is different for criminal cases. In Missouri, criminal defense attorneys may depose witnesses as part of the discovery process. However, many other state courts (such as Illinois) and federal court do not allow depositions in criminal cases except under very limited circumstances.
Please answer the following two questions in 200 to 500 words for each question (a total of 400 to 1000 words for the entire essay). If you retype the question as a heading, the question will not be applied against the word count.
- Why are depositions an important discovery tool for criminal defense attorneys to ensure their clients receive a fair trial?
- What are your thoughts on the fact that all state courts and federal court allow depositions for civil cases but not for criminal cases?
